I'm very pleased with the performance of all the folks who helped me at Lowry and Associates after my car accident a year and a half ago.  From Attorney Beardsley who agreed to take my case when another firm I contacted had passed on it, to Annabelle, (a paralegal?) who called consistently every few weeks to keep me abreast on the details of what was happening with my case, and who was very patient and kind even when I expressed frustration when it seemed like nothing was happening. And finally l'm thankful  for Attorney Reilly, who worked the details of my case and who, when the time came to negotiate with the other party's insurance company, secured me a settlement way more than I had imagined I would receive. I came to this law firm in 2023 after a really bad motorcycle accident. I was afraid and nervous to even make the call but when I connected with Colin he wasted no time at all in getting me in for the in person visit. When my dad and I got to the office I was blown away by the hospitality I was given by Colin himself,  I was still on crushes and had all sorts of road rash and he did not do or ask anything about the case further until he knew I was comfortable enough. After three years of the back and forth between both the team and the insurance they made sure they got the most amount of money that they could and the foot work from anabelle is truly incredible. They were in touch every month by phone call (unless nothing happened during that month) and I truly believe there was no other team besides jay, Annabelle and attorney Colin that could have worked my case the way they did. Beyond impressed and I will most definitely be recommending anyone and everyone who asks me if I know a lawyer to Lowry associates. 10/10 thank you guys so so SO much for all of your hard work and support! I was involved in a head on car crash in the fall of 2023. Lowry and Associates were amazing from day 1. James Beardsley came out to my place of residence for our first meeting. He was pleasant and explained how the entire process worked. He assured me that I wouldn’t have to worry about anything, just healing. The office kept in contact with me every month and a half updating me on what was taking place. By then end I was working with Ashley who drove out to me so I could sign the finalized documents. Everything went smoothly and quicker than expected. The whole process was a little over a year. If you are ever hesitant to get a lawyer or not- GET A LAWYER. Call the 2’s. In June of 2022, a pickup truck veered across the center line and hit us nearly head-on. The accident resulted in serious injuries, hospitalization, and months of recovery. After a major motorcycle accident involving another driver making a left turn directly in front of me, Lowry and Associates got involved because I had hit a dead end and they worked on my case for a couple years. Finally they were able to settle my case and get compensation for me that allows me to move forward. You will not be disappointed! My wife was in a horrific car crash that was no fault of her own. Ashley, Kathy, and team were so empathetic, sympathetic, and caring that it made us feel as if we were family. We rec'd more than expected and in half the time expected. This was so appreciated as bills were mounting, but Ashley and Kathy were with us every step of the way to put our stress in check. Where they are was convenient to me. However, after my dealings with this firm, I will travel as far as necessary to go there should I ever need the services of a law firm again. They made it as easy as possible, even though this was the worst experience of our lives. We were emotionally distraught, but they were a HUGE part of the healing process. Our best interest was ALWAYS at the forefront with these wonderful people. As bad as the accident was, I couldn't imagine going though that without the compassion of Ashley and Kathy. How Fault Affects Your Car Accident Claim

Figuring out who caused a car accident is an important part of deciding who may have to pay for the injuries and losses that follow. Sometimes fault is clear. Other times, drivers disagree about what happened, an insurance company tries to shift blame, or several people contributed to the crash.

Determining fault may require looking at how the accident happened, which Maine traffic laws apply, and what the evidence shows. In a complicated crash, more than 1 person or company may share responsibility. A car accident attorney can investigate the crash, identify who may be responsible, and gather evidence to support your case.

Maine Is an At-Fault State for Car Accidents

Maine is an at-fault state, which means the person who caused a car accident may be financially responsible for the injuries and losses that result. If another driver’s negligence caused your crash, you may be able to pursue compensation through that driver’s insurance or, when necessary, a lawsuit.

Fault may also extend beyond the driver. Depending on how the accident occurred, a vehicle owner, employer, manufacturer, or another party could potentially share responsibility.

An insurance company’s initial decision about fault doesn’t necessarily settle the issue. Your attorney can conduct an independent investigation and challenge attempts to unfairly place responsibility on you.

How Do You Prove Negligence in a Car Accident Case?

In legal terms, negligence occurs when someone fails to act with the level of care that a reasonable person would in similar circumstances. In car accident cases, this means drivers are expected to follow the rules of the road, obey traffic signs, and stay alert while driving.

To establish negligence, you need to prove each of these 4 elements:

1. Duty of Care: The other person had a legal responsibility to act with reasonable care.
2. Breach of Duty: The person failed to meet that responsibility.
3. Causation: The person’s actions must have caused the accident and your injuries.
4. Damages: You must have suffered an actual loss because of the accident.

What If You Were Partly at Fault for the Accident?

Even if you contributed to the accident, you may still be able to recover compensation under Maine’s comparative negligence law. If you’re found to be less than 50% at fault, the amount of compensation you may be entitled to will be reduced by your percentage of fault. For example, if you are found 30% responsible, your compensation will be reduced by 30%.

However, you could be barred from receiving compensation if you’re found to be 50% or more at fault for the accident. Because of this rule, insurance companies may try to place more responsibility on you to reduce what they pay. An attorney can review the facts, challenge unfair attempts to blame you, and use evidence to show how the other party caused or contributed to the accident.

What Evidence Can Help Prove Fault?

A successful car accident case often depends on being able to show how the crash happened, who was responsible, and how you were harmed. Depending on the circumstances, evidence used to determine fault may include:

• Police and crash reports
• Photos and videos of the accident scene
• Vehicle damage
• Dashcam footage
• Traffic or surveillance camera recordings
• Witness statements
• Skid marks, debris, and other physical evidence
• Traffic signals and signs
• Road and weather conditions
• Cellphone records in distracted-driving cases
• Vehicle event data
• Medical records connecting your injuries to the collision
• Testimony or analysis from accident reconstruction and other qualified experts when necessary

Evidence can disappear quickly. Video footage may be deleted, vehicles may be repaired, road conditions can change, and witnesses may forget important details.
